If you were assessed certain nonsufficient funds (“NSF”) Fees and/or Overdraft Fees between February 19, 2015, and October 30, 2019, or certain ATM fees between February 19, 2015, and February 28, 2021, you may be entitled to a payment from a class action settlement.


Your Legal Rights and Options in This Settlement
Do Nothing If you were assessed the type of NSF and/or Overdraft Fee or ATM fee that is being challenged in this case, you will receive a payment from the Settlement Fund so long as you do not exclude yourself (described below).
Exclude Yourself from the Settlement;
Receive No Payment but Release No Claims
You could have chosen to exclude yourself from the settlement or “opt out.” This means you chose not to participate in the settlement. You will keep your individual claims against Defendant, but you will not receive a payment. If you excluded yourself and want to recover against Defendant, then you will have to file a separate lawsuit or claim. The deadline to exclude yourself from the Settlement has passed.
Object to the Settlement You could have filed an objection with the Settlement Administrator explaining why you believe the Court should reject the settlement. If you objected and your objection is overruled by the Court, you will receive a payment and you will not be able to sue Defendant for the claims asserted in this litigation. If the Court agrees with your objection, then the settlement may not be approved. The deadline to submit an objection has passed.
